Terms and conditions of sale

Article 1 — Purpose

These terms and conditions of sale govern the provision by ProxyMobile SAS, the Provider, of an internet access service by relay, consisting in making network egress points available to the customer using French mobile connections over HTTP and SOCKS5, the Service.

Any order implies unreserved acceptance of these terms. The customer acknowledges having read them before confirming the order.

Article 2 — Description of the plans

The Service is offered as fixed-term subscriptions, one-off purchases and trials. The characteristics of each plan (duration, included data volume, shared or dedicated access mode, frequency of address rotation) are described on the pricing page and repeated in the customer portal at the time of order.

The Service does not include supplying the customer with an internet connection, nor installing equipment at the premises of the customer. The customer must have their own connection and tools to use the egress points provided.

Article 3 — Prices and billing

Prices are shown in euros, inclusive of all taxes, on the pricing page. They are payable in advance by card through our payment provider Stripe. No set-up fee is charged.

The included data volume is the one attached to the chosen plan. It resets at each renewal period. The customer may buy extra volume at the unit rate shown; this volume stacks and does not expire while the subscription is active.

If the volume is exceeded without a top-up purchase, the proxy connection is suspended until the period renews or extra volume is bought. No overage is ever billed automatically.

Article 4 — Term, renewal and cancellation

Plans are taken out with no minimum term. Plans with automatic renewal can be cancelled at any time from the customer portal: cancellation takes effect at the end of the current period, without penalty.

The Provider may suspend or terminate the Service in the event of a serious breach of these terms by the customer, in particular unlawful use (Article 6). In that case no refund is due for unused volume.

Article 5 — Right of withdrawal and refunds (consumers)

Under French consumer law, a consumer customer has fourteen (14) days from subscription to exercise their right of withdrawal, without having to give a reason.

This right is exercised by a simple written request to support@proxymobile.fr. The refund is made to the original payment method within fourteen (14) days of the request.

Under French consumer law, the right of withdrawal does not apply to services fully performed before the end of the period where the customer has expressly requested immediate performance. A 24-hour trial that has been consumed therefore does not qualify for a refund.

Article 6 — Lawful use — prohibited activities

The Service is provided for lawful purposes. The customer expressly undertakes not to use it for, among other things:

  • sending unsolicited messages (spam), bulk email or any non-consented communication, including through instant messaging, social networks or contact forms;
  • fraudulent, deceptive or criminal activity: identity theft, creating accounts in violation of a platform terms, price manipulation, circumvention of contractual geo-restrictions, fake reviews;
  • cyberattacks, unauthorised vulnerability scanning, intrusion attempts, denial of service, exploitation of flaws;
  • collecting personal data without a legal basis, breaching the GDPR, collecting copyrighted content or defeating paywalls;
  • any activity prohibited by French law or by applicable law.

Article 7 — Quotas, throughput and availability

The Provider applies no artificial throughput cap on the plans concerned. Actual throughput depends on cellular coverage, line load and the network conditions of the mobile carrier. The Provider does not guarantee any minimum throughput value.

Shared plans carry a cap on simultaneous connections, shown in the customer portal. Dedicated plans reserve a line for the customer, whose availability was guaranteed at the time of order.

The Provider endeavours to ensure continuous availability, without guaranteeing the absence of interruption. Interruptions caused by maintenance, cellular network incidents or technical suppliers such as the hosting or payment provider do not give rise to compensation, subject to mandatory legal provisions.

Article 8 — Credentials and security

The customer is responsible for keeping their proxy credentials confidential. Any use of the credentials is deemed to be made by the customer. If a compromise is suspected, the customer must regenerate their password immediately from the customer portal.

Article 9 — Personal data

Personal data processing is described in the privacy policy. The customer has the rights provided by the GDPR, exercisable at legal@proxymobile.fr.

Article 10 — Liability

The liability of the Provider is limited to the amount actually paid by the customer over the last twelve months. The Provider cannot be held liable for indirect damages, loss of business, loss of data or harm resulting from use of the Service that does not comply with these terms.

Article 11 — Changes to these terms

The Provider may change these terms at any time. The conditions applicable are those in force on the day of the order. Any substantial change is notified to the customer by email at least thirty (30) days before it takes effect, and the customer may then cancel at no cost.

Article 12 — Governing law and disputes

These terms are governed by French law. In the event of a dispute the parties will seek an amicable solution. A consumer customer may use the French consumer mediator free of charge, or the European online dispute resolution platform. Failing an amicable resolution, the French courts have jurisdiction.
